Fixnx Terms of Use

Core rule: Fixnx may be used only for lawful, defensive, and authorized website security testing. If you do not own or have clear permission to test an asset, do not scan it.
These terms are provided for product use and risk management. They should be reviewed by qualified legal counsel for your company, jurisdiction, customer contracts, and operating model.

Welcome to Fixnx. In these Terms, Fixnx, we, our, and us refer to the Fixnx service provider. These Terms of Use govern your access to and use of the Fixnx website, platform, scanning tools, reports, dashboards, alerts, APIs, and related services collectively called the Service.

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not access or use the Service.

1. Important Security and Authorization Notice

Fixnx is designed only for lawful, defensive, and authorized website security testing.

You may use the Service only to scan, test, monitor, or analyze websites, domains, systems, applications, infrastructure, or digital assets that you own, control, administer, or have received clear and valid authorization to test from the lawful owner or authorized representative.

You must not use Fixnx to scan, test, access, monitor, interfere with, attack, disrupt, exploit, overload, reverse engineer, or collect information from any website, system, network, application, domain, or digital asset without proper authorization.

Any unauthorized use of the Service is strictly prohibited, is not authorized by Fixnx, may be unlawful, and may expose you to civil, criminal, administrative, or other legal liability in one or more jurisdictions.

Fixnx does not grant you permission to test, scan, access, or interact with any third-party system. Authorization must come from the lawful owner or authorized operator of the relevant asset.

2. Purpose of the Service

Fixnx provides tools intended to help website owners, developers, security teams, agencies, and businesses identify potential security, configuration, compliance, performance, and technical risks in their own authorized digital assets.

Fixnx is not an offensive security tool and must not be used for hacking, exploitation, unauthorized reconnaissance, unlawful surveillance, data theft, disruption, abuse, or any other illegal or harmful activity.

  • Identifying potential security weaknesses.
  • Improving website protection.
  • Monitoring websites for security issues.
  • Generating reports for internal remediation.
  • Supporting responsible maintenance of websites and applications.
  • Helping authorized users understand and reduce technical risk.

3. Eligibility

You may use the Service only if you are legally capable of entering into a binding agreement under the laws that apply to you.

If you use the Service on behalf of a company, organization, agency, client, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.

5. Authorization Requirement

Before using Fixnx to scan or test any website, domain, IP address, application, API, server, cloud environment, system, or other asset, you must ensure that you have valid authorization.

You must be able to prove authorization if Fixnx requests it. Fixnx may require domain verification, ownership verification, written confirmation, client authorization, or other proof before allowing or continuing a scan.

Fixnx may suspend, limit, cancel, or block any scan or account if we believe that authorization is missing, unclear, invalid, expired, disputed, or insufficient.

  • Ownership of the asset.
  • Administrative control over the asset.
  • Written permission from the lawful owner.
  • Written permission from an authorized client.
  • Contractual authorization to perform security testing.
  • Authorization under a valid bug bounty or vulnerability disclosure program, strictly within its published scope.

6. Strictly Prohibited Uses

You must not use the Service for any purpose that is unlawful, harmful, abusive, offensive, deceptive, unauthorized, or inconsistent with these Terms.

  1. Scanning, testing, or monitoring any asset without authorization from the lawful owner or authorized operator.
  2. Attempting to gain unauthorized access to any system, account, database, network, server, application, API, cloud environment, or data.
  3. Exploiting vulnerabilities or attempting to use any finding to compromise, damage, disrupt, or control a system.
  4. Launching, assisting, simulating, or facilitating attacks, including denial-of-service attacks, distributed denial-of-service attacks, brute force attacks, credential stuffing, phishing, malware activity, ransomware activity, bot activity, spam, or social engineering.
  5. Collecting, extracting, scraping, harvesting, copying, downloading, or exposing data without authorization.
  6. Bypassing authentication, authorization, rate limits, paywalls, access controls, security controls, account restrictions, CAPTCHAs, firewalls, or monitoring systems.
  7. Scanning government, military, law enforcement, critical infrastructure, healthcare, financial, educational, or public-sector systems without explicit written authorization.
  8. Using the Service to threaten, extort, blackmail, harass, defame, intimidate, or pressure any person or organization.
  9. Selling, publishing, disclosing, or weaponizing security findings without authorization.
  10. Using Fixnx reports to claim that a third party is insecure unless you are legally authorized to make that claim and have verified the findings responsibly.
  11. Using the Service to develop, improve, test, or operate malware, exploit kits, attack tools, botnets, phishing kits, or other harmful tools.
  12. Interfering with the Service, Fixnx infrastructure, other users, or third-party systems.
  13. Attempting to reverse engineer, copy, clone, resell, scrape, overload, or abuse the Service.
  14. Misrepresenting your identity, authority, ownership, affiliation, or permission to test an asset.
  15. Using the Service in violation of sanctions, export controls, or restrictions applicable to cybersecurity technology.
  16. Using the Service for any non-defensive, unauthorized, illegal, or harmful purpose.

7. Defensive Use Only

You agree that the Service may be used only to help protect authorized assets.

You must not use any scan result, report, alert, recommendation, vulnerability indication, technical detail, or other output from Fixnx to attack, exploit, access, damage, disrupt, or compromise any system.

If the Service identifies a potential issue, you must handle it responsibly and only for remediation, reporting, protection, or lawful authorized security work.

8. Domain and Asset Verification

Fixnx may require verification before allowing scans or certain features. Verification may include DNS verification, file upload verification, email verification, account verification, administrative confirmation, client authorization, or other methods.

Fixnx may refuse to scan any asset if ownership or authorization is not sufficiently verified.

Fixnx may also restrict scans based on risk, sensitivity, abuse signals, legal concerns, infrastructure impact, or third-party complaints.

9. Scan Limits and Service Controls

Fixnx may apply technical limits to protect websites, networks, infrastructure, and the Service. You must not attempt to bypass these limits.

Fixnx may stop, delay, throttle, cancel, or block any scan at any time if we believe it may be unauthorized, harmful, excessive, illegal, risky, abusive, or inconsistent with these Terms.

  • Scan frequency limits.
  • Rate limits.
  • Timeout limits.
  • Target restrictions.
  • Account limits.
  • Temporary scan pauses.
  • Automatic blocking.
  • Manual review.
  • Verification requirements.
  • Abuse monitoring.

10. Reports and Results

Fixnx may generate reports, scores, alerts, recommendations, explanations, or technical findings.

You are responsible for reviewing, validating, prioritizing, and remediating findings.

  • Reports may contain false positives.
  • Reports may miss issues.
  • Reports may be incomplete.
  • Security conditions may change after a scan.
  • A clean or safe result does not guarantee that a website is secure.
  • Fixnx does not guarantee that all vulnerabilities, risks, misconfigurations, or compliance issues will be detected.
  • Fixnx does not provide a certification, audit opinion, legal opinion, compliance guarantee, penetration test certification, insurance approval, or security warranty.

11. No Guarantee of Security

The Service is provided to assist with security awareness and improvement. It does not guarantee protection from hacking, compromise, malware, data breaches, outages, legal claims, regulatory action, reputational harm, financial loss, or any other damage.

You remain solely responsible for securing your websites, systems, accounts, servers, infrastructure, code, data, cloud environments, and users.

12. Responsible Disclosure

If you discover a vulnerability, weakness, misconfiguration, exposure, or security issue affecting a third party, you must disclose it only through lawful and responsible channels.

You must not publicly disclose, sell, exploit, threaten to disclose, or misuse any vulnerability or security finding unless you are legally authorized to do so.

If you discover a security issue affecting Fixnx, you agree to report it responsibly to us and not exploit, disclose, or misuse it.

13. Account Registration and Security

You may need an account to use certain parts of the Service. You agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must notify Fixnx immediately if you believe your account has been compromised or used without authorization.

You must not share, sell, transfer, or provide access to your account in a way that violates these Terms.

14. Customer Data and Scan Data

When you use the Service, you may submit or generate data, including URLs, domains, scan targets, technical metadata, scan results, reports, configurations, account information, and related content (Customer Data).

You represent and warrant that you have all rights, permissions, authorizations, and legal bases required to submit Customer Data to Fixnx and to allow Fixnx to process it for the purpose of providing the Service.

You remain responsible for Customer Data and for ensuring that your use of the Service complies with applicable privacy, confidentiality, contractual, and data protection obligations.

  • Provide, maintain, and improve the Service.
  • Perform scans and generate reports.
  • Detect abuse, fraud, and unauthorized activity.
  • Secure the Service.
  • Provide support.
  • Comply with legal obligations.
  • Enforce these Terms.

15. Personal Data and Privacy

Your use of the Service may involve the processing of personal data.

You agree that you will not submit personal data to the Service unless you have a lawful basis and all required notices, permissions, consents, contracts, or other legal grounds required under applicable privacy laws.

Where applicable, you are responsible for complying with privacy and data protection laws, including laws that may apply in the European Union, United Kingdom, Israel, California, and other jurisdictions.

Fixnx's handling of personal data is described in our Privacy Policy. If required by law or contract, additional data processing terms may apply.

You must not use the Service to unlawfully collect, expose, process, or disclose personal data.

16. Confidentiality

Scan results and reports may contain sensitive security information. You are responsible for protecting reports, findings, dashboards, exports, alerts, screenshots, logs, and any other security-related information generated by the Service.

You must not share security findings with unauthorized parties.

You must not use Fixnx reports to harm, embarrass, extort, pressure, threaten, or mislead any person or organization.

17. Third-Party Services and Infrastructure

The Service may interact with or depend on third-party websites, hosting providers, cloud providers, APIs, integrations, analytics providers, payment processors, email providers, security tools, or other external services.

Fixnx is not responsible for third-party services, third-party systems, third-party content, third-party policies, or third-party availability.

Your use of third-party services may be subject to separate terms and policies.

18. Payments, Plans, and Subscriptions

Certain features may require payment. If you purchase a paid plan, subscription, credit package, or other paid feature, you agree to pay all applicable fees, taxes, and charges.

Unless stated otherwise at the time of purchase, fees are non-refundable except where required by law.

Fixnx may change pricing, features, plan limits, or billing terms by providing notice where required.

19. Intellectual Property

Fixnx and its licensors own all rights, title, and interest in and to the Service, including software, technology, design, branding, logos, text, report templates, algorithms, models, workflows, user interface, documentation, and all related intellectual property.

These Terms do not transfer ownership of Fixnx intellectual property to you.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or create derivative works based on the Service except as expressly permitted by law or by written permission from Fixnx.

20. Feedback

If you provide suggestions, ideas, improvements, bug reports, or feedback, you grant Fixnx a worldwide, royalty-free, perpetual, irrevocable license to use, modify, publish, and incorporate that feedback without restriction or compensation to you.

21. Service Availability

Fixnx may update, modify, suspend, limit, discontinue, or remove any part of the Service at any time.

We do not guarantee uninterrupted, error-free, secure, or continuous availability.

We are not responsible for downtime, delays, data loss, scan interruptions, report errors, or service limitations.

22. Suspension and Termination

Fixnx may suspend, restrict, or terminate your access to the Service at any time if we believe that a violation or risk exists. You may stop using the Service at any time.

Sections that by their nature should survive termination will survive, including authorization requirements, prohibited use restrictions, intellectual property, disclaimers, limitation of liability, indemnification, and dispute provisions.

  • You violated these Terms.
  • Your use may be unauthorized or illegal.
  • Your use may harm Fixnx, users, third parties, or infrastructure.
  • Your account is associated with abuse, fraud, risk, or security concerns.
  • Required verification was not completed.
  • We are required to do so by law, regulation, court order, government request, provider request, or third-party complaint.

23. Abuse Monitoring, Logging, and Reporting

Fixnx may monitor usage of the Service to detect abuse, unauthorized scanning, fraud, security incidents, operational risk, excessive traffic, sanctions issues, and violations of these Terms.

Where permitted by law, Fixnx may preserve logs, scan metadata, account information, payment records, target information, IP addresses, user agents, timestamps, reports, and communications when needed to investigate, prevent, or respond to abuse or legal requests.

If Fixnx believes the Service is being used for illegal, unauthorized, harmful, or abusive activity, Fixnx may report relevant information to affected asset owners, hosting providers, cloud providers, domain registrars, payment processors, email providers, law enforcement, regulators, or other appropriate parties.

24. No Authorization for Third-Party Systems

Your access to Fixnx does not create authorization to scan, test, monitor, probe, access, or interact with any third-party website, network, system, application, API, server, domain, infrastructure, or data.

Fixnx is a tool provider. You are responsible for obtaining permission from the lawful owner or authorized operator of each asset before using the Service.

If a third party claims that your scan was unauthorized, you are responsible for proving your authorization and for any consequences arising from your use of the Service.

25. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided as is and as available.

Fixnx disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, reliability, and error-free operation.

Fixnx does not warrant that the Service will detect all vulnerabilities, prevent attacks, ensure compliance, remove risk, or make any website secure.

26. Limitation of Liability

To the maximum extent permitted by law, Fixnx, its owners, officers, employees, contractors, affiliates, suppliers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including loss of profits, loss of revenue, loss of business, loss of goodwill, loss of data, security incidents, service interruptions, legal claims, regulatory penalties, or reputational harm.

To the maximum extent permitted by law, Fixnx's total liability for any claim relating to the Service or these Terms will not exceed the amount you paid to Fixnx for the Service during the three months before the event giving rise to the claim, or USD $100 if you did not pay for the Service.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

27. Indemnification

You agree to defend, indemnify, and hold harmless Fixnx, its owners, officers, employees, contractors, affiliates, suppliers, and partners from and against any claims, damages, losses, liabilities, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

  • Your use or misuse of the Service.
  • Your violation of these Terms.
  • Your violation of any law or regulation.
  • Your scanning or testing of any unauthorized asset.
  • Your lack of valid authorization.
  • Your Customer Data.
  • Your violation of third-party rights.
  • Your security testing, disclosure, reports, or remediation activity.
  • Any claim that your use of the Service caused harm to a third party.

28. Export Controls and Sanctions

You may not use, access, export, re-export, provide, transfer, or make available the Service in violation of applicable export control, sanctions, anti-terrorism, cybersecurity, or trade laws.

You represent that you are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to applicable comprehensive sanctions, and that you are not listed on any applicable restricted party list.

You must not use the Service for prohibited military, surveillance, cyber-offensive, unlawful, or sanctioned purposes.

29. Consumer Rights

Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.

If you are a consumer in a jurisdiction with mandatory consumer protections, those protections may apply to you.

30. Changes to These Terms

Fixnx may update these Terms from time to time. If we make material changes, we may provide notice through the website, account dashboard, email, or other reasonable means.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.

31. Governing Law and Dispute Resolution

Unless mandatory law requires otherwise, these Terms are governed by the laws of the State of Israel, without regard to conflict of law rules.

Any dispute arising from or related to these Terms or the Service will be resolved exclusively in the competent courts of Tel Aviv-Jaffa, Israel, unless mandatory law requires otherwise.

You are responsible for obtaining independent legal advice if another jurisdiction, contract, employer policy, platform policy, or customer agreement applies to your use of the Service.
